Terms of Service

1. Acceptance of Terms

By accessing or using TrainerDNA, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the service. TrainerDNA is operated by Tandem DNA Marketing LLC ("we", "us", "our").

2. Description of Service

TrainerDNA is a SaaS growth workspace for online fitness coaches. It helps coaches manage leads, client follow-up, pricing and payment follow-up, proof, content planning, retention, calendar context, and connected platform signals. Features may change, improve, or be added over time.

3. Eligibility and Accounts

• You must be at least 18 years old, or the age of majority in your jurisdiction.
• You must provide accurate, current, and complete account information.
• You are responsible for maintaining the security of your account and password.
• You are responsible for all activity that occurs under your account and workspace.

4. Beta / Availability

TrainerDNA may be offered in beta. Features, functionality, and availability may change without notice. We do not guarantee uptime, continuous availability, or uninterrupted service.

5. Acceptable Use

You agree not to:

• Use TrainerDNA for any illegal purpose or in violation of any applicable law.
• Abuse, overload, or attempt to disrupt the service or its infrastructure.
• Scrape, reverse engineer, or decompile any part of TrainerDNA.
• Upload, store, or transmit unlawful, harmful, or infringing content.
• Misuse data from connected third-party platforms beyond the scope you authorized.
• Use TrainerDNA to spam, harass, or send unsolicited messages.
• Interfere with security features or circumvent access controls.

6. Connected Third-Party Accounts

You may connect third-party services such as Meta/Facebook/Instagram, Google, TikTok, YouTube, Stripe, or other platforms. You authorize TrainerDNA to access only the data and permissions you approve through the relevant OAuth or authorization flow. You can disconnect these accounts at any time from inside the app.

7. Meta / Facebook / Instagram Platform Compliance

You are responsible for following Meta, Facebook, and Instagram terms, policies, and rules when connecting or using those services through TrainerDNA.

TrainerDNA's current Meta-related features are read-only. TrainerDNA does not post, publish, delete, comment, message, or modify Facebook or Instagram content through the currently reviewed read-only integrations, unless a separate future feature receives explicit authorization.

TrainerDNA handles Meta Platform Data as described in our Privacy Policy and does not sell Meta Platform Data or use it outside the authorized connected-account features.

8. Client and Prospect Data

You are responsible for having permission and a lawful basis to enter any client or prospect information into TrainerDNA. You are responsible for complying with applicable privacy, data protection, and marketing laws in your jurisdiction.

9. Fitness / Health Disclaimer

TrainerDNA is a business operations and growth tool. It is not medical advice, fitness programming, legal advice, tax advice, or financial advice. Always consult appropriate professionals for those matters.

10. AI Recommendations Disclaimer

TrainerDNA may use AI to generate recommendations, summaries, or suggestions. These outputs may be incomplete, inaccurate, or not suitable for every situation. You are responsible for reviewing AI-generated content before relying on it or acting on it.

11. Payments and Billing

TrainerDNA may be free during beta. If paid features exist or are introduced later, billing terms will be presented clearly before any purchase. We may use Stripe or other payment processors to handle transactions. You agree to pay all applicable fees and taxes.

12. User Content and Ownership

You retain ownership of all content, client data, business information, and connected account data you add to TrainerDNA. You grant TrainerDNA a limited license to host, process, and display that content solely to provide the service to you and your authorized workspace members.

13. Intellectual Property

TrainerDNA software, branding, design, user interface, and content belong to Tandem DNA Marketing LLC or its licensors. You may not copy, modify, distribute, or create derivative works from TrainerDNA without our written permission.

14. Termination and Deletion

You may stop using TrainerDNA and request deletion of your account or workspace at any time. We may suspend or terminate your account for abuse, legal risk, non-payment, or violation of these Terms. We will provide notice where reasonably possible.

15. Privacy

Your use of TrainerDNA is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

17. Disclaimers

TrainerDNA is provided "as is" and "as available" to the fullest extent permitted by law. We do not guarantee that the service will be uninterrupted, error-free, secure, or free of harmful components. We disclaim all warranties, express or implied, except as required by law.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Tandem DNA Marketing LLC and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of TrainerDNA, even if advised of the possibility of such damages.

19. Changes

We may update these Terms from time to time. When we do, we will post the updated version here and update the "Last updated" date at the top of this page. Continued use of TrainerDNA after changes means you accept the updated Terms.

20. Governing Law

These Terms are governed by the laws of the United States and the State of New York, without regard to conflict-of-laws principles. Any disputes will be resolved in the state and federal courts located in New York, where permitted.
